1. General Provisions

  1. The online store elastoring.eu, operating at https://elastoring.eu (platform: lemming.shop), is operated by Lemming Spółka z ograniczoną odpowiedzialnością with its registered office in Rzeszów, Poland, entered into the National Court Register under number KRS: 0000532194, VAT ID PL8133698802, REGON 360173641.

  2. These Terms and Conditions define the rules of using the online store, placing orders, concluding and performing sales contracts, delivery, payment methods, complaints, withdrawal rights, and personal data protection.
  3. The Terms and Conditions apply to both consumers and business customers (B2B) using the online store.
  4. Using the store means acceptance of these Terms and Conditions. Customers are obliged to read them before placing an order.
  5. The Seller reserves the right to modify the Terms and Conditions for valid reasons, including changes in law, the range of services, payment methods, or delivery options. Any change becomes effective upon publication on the store’s website and applies to orders placed after that date.
  6. Contracts concluded through the online store are governed by Polish law.
    The language of the contract is Polish; communication in English is also possible for international customers.

2. Definitions

  1. Store – the online store available at https://elastoring.eu (additional domain: lemming.shop).
  2. Seller – Lemming Spółka z ograniczoną odpowiedzialnością, based in Rzeszów, Poland.
  3. Customer (Buyer) – any individual or legal entity purchasing goods through the store.
  4. Consumer – a natural person making a purchase not directly related to business or professional activity.
  5. Business Customer – a person or entity conducting business activity, including entrepreneurs with consumer rights.
  6. Product (Goods) – items offered for sale, including technical seals, hydraulic components, and related accessories.
  7. Sales Contract – a distance contract concluded between the Seller and the Customer through the store.
  8. Order Form – an interactive form used to place an order by adding products to the cart and providing order details.
  9. Account – an individual Customer account in the store allowing order tracking and data management.
  10. Business Days – days from Monday to Friday, excluding public holidays in Poland.
  11. Terms and Conditions – this document.

3. Technical Requirements

  1. To use the online store, the Customer must have:
    • a device with Internet access,
    • an up-to-date web browser (e.g. Chrome, Firefox, Safari, Edge),
    • an active e-mail address,
    • cookies and JavaScript enabled.
  2. Placing an order and using the full functionality of the store requires registration and logging in to the user account.
  3. The Customer must use the store in accordance with the law, good manners, and without interfering with its operation or providing unlawful content.
  4. The Seller uses technical and organizational measures to ensure the security of data and online communication, including SSL encryption.
  5. The store uses cookies to ensure proper operation, analytics, and personalization. Details are provided in the Privacy and Cookies Policy.

4. Scope of Store Activity

  1. The store sells technical seals, hydraulic components, and related technical accessories.
    The offer is directed to both individual and business customers (B2B) in Poland and abroad.
  2. Product prices are displayed in the currencies supported by the store, including but not limited to PLN, EUR, HUF, CZK, GBP, and others that may be introduced in the future.
    The currency may be selected automatically (based on the Customer’s location) or manually.
  3. Prices are displayed gross (with VAT) or net (without VAT) depending on the Customer’s status and delivery country:
    • Polish customers – prices include VAT,
    • EU business customers with a valid VAT EU number – prices are net (without VAT),
    • EU customers without a VAT EU number – prices include VAT according to the OSS procedure,
    • Non-EU customers – prices are net, without VAT.
  4. Delivery costs are shown separately during order placement.
  5. The Seller reserves the right to change prices or delivery costs without affecting orders already placed.
  6. Product images and descriptions are for reference only and may slightly differ from the actual product without affecting its properties or quality.

5. Orders

  1. Orders may only be placed by registered Customers with an active account.
  2. To place an order, the Customer:
    • adds selected products to the shopping cart,
    • selects a delivery method and payment option,
    • verifies order details and confirms the purchase by clicking the “Order and Pay” button (or equivalent).
  3. Submitting an order constitutes an offer to conclude a sales contract.
    The contract is concluded once the Seller sends an e-mail confirming the acceptance of the order for processing.
  4. The Customer receives an order confirmation at the e-mail address provided during registration.
  5. The Seller processes orders on Business Days, in the order received, until stock is exhausted.
  6. The Customer is responsible for providing accurate and complete data necessary for the order (contact, address, tax identification, etc.).
  7. The Customer may cancel or modify an order before processing begins by contacting the Seller directly.
  8. The Seller reserves the right to cancel orders in case of obvious pricing or technical errors.

6. Payments

  1. Payment methods available in the store:
    • bank transfer – to the Seller’s account specified in the order confirmation or pro forma invoice,
    • online payment – via payment service providers such as PayU, Revolut, or PayPal,
    • cash on delivery – available only within Poland.
  2. Payment details for bank transfers are provided in the order confirmation or on the issued pro forma invoice.
  3. The Customer must complete the payment within 3 calendar days from the date of placing the order, unless stated otherwise.
  4. If payment is not received within this period, the Seller may cancel the order after notifying the Customer.
  5. Orders paid online are processed after the Seller receives confirmation of successful payment authorization.
  6. All transactions are secured with SSL encryption, and the Seller does not store payment card details.
  7. The payment currency is determined automatically based on the delivery country or selected manually from the currencies supported by the store (PLN, EUR, HUF, CZK, GBP, and others).
  8. The Customer receives proof of purchase in accordance with applicable tax regulations:
    • Polish customers – fiscal receipt or, upon request, a VAT invoice,
    • EU customers with a valid VAT EU number – invoice without VAT,
    • EU customers without a VAT EU number – invoice with VAT according to OSS rules,
    • Non-EU customers – invoice without VAT.

7. Delivery

  1. Deliveries are carried out via courier and logistics companies cooperating with the Seller.
    The choice of carrier may vary depending on the destination country, parcel size, and logistics options.
  2. Products are shipped to Poland, EU countries, and non-EU countries, in compliance with applicable customs and transport regulations.
  3. Delivery costs are specified during the order process and depend on:
    • the delivery method chosen,
    • the destination country,
    • the weight and size of the shipment.
  4. The total delivery cost is displayed before confirming the order.
  5. Orders are processed on Business Days after payment confirmation or with cash-on-delivery option.
  6. In case of visible transport damage or missing items, the Customer should, if possible, draw up a damage report with the courier and notify the Seller promptly.
  7. The Seller is not responsible for delivery delays caused by the carrier after timely dispatch of the goods.

8. Withdrawal from the Contract (Returns)

  1. Consumers have the right to withdraw from a distance contract within 14 calendar days from receiving the goods, without giving any reason.
  2. To exercise this right, the Customer must send a withdrawal statement by e-mail to biuro@elastoring.eu or by mail to:
    Lemming Sp. z o.o., ul. Hanasiewicza 10, 35-103 Rzeszów, Poland.
  3. To meet the deadline, it is sufficient to send the withdrawal statement before its expiry.
  4. Return shipping costs are borne by the Customer unless the Seller specifies otherwise.
  5. The Seller refunds the payment within 14 days of receiving the withdrawal statement, using the same payment method, unless agreed otherwise.
  6. The right of withdrawal does not apply to:
    • goods made to the Customer’s specification or clearly personalized,
    • goods that have been opened or used and cannot be resold as new,
    • goods that cannot be returned for hygiene or technical reasons.
  7. The right of withdrawal does not apply to business customers (B2B), except where consumer rights apply under relevant law.
  8. For international consumers, the applicable local consumer protection laws of the delivery country may apply, provided they do not conflict with Polish law.

9. Complaints and Warranty

  1. The Seller is obliged to deliver goods free from defects.
    In case of non-conformity, the Customer has the right to submit a complaint.
  2. Complaints may be submitted by e-mail to biuro@elastoring.eu or in writing to the company address.
  3. The complaint should include:
    • Customer identification and contact details,
    • order or invoice number,
    • description of the defect and date of its occurrence,
    • Customer’s demand (repair, replacement, price reduction, or withdrawal).
  4. The Seller reviews the complaint within 14 calendar days and informs the Customer of the decision by e-mail or other agreed means.
  5. If the complaint is accepted, the Seller covers the costs of repair, replacement, or return shipping.
  6. Products may be covered by a manufacturer’s or distributor’s warranty, if provided.
    Warranty terms are specified in the accompanying documentation or by the manufacturer.
  7. The provisions of this section do not limit the Customer’s statutory rights under applicable law.
  8. Business customers (B2B) are entitled to warranty rights as defined by the Polish Civil Code, excluding consumer-specific provisions.

10. Personal Data Protection (GDPR)

  1. The data controller is Lemming Spółka z ograniczoną odpowiedzialnością, based in Rzeszów, Poland.

  2. Personal data are processed for:
    • order fulfillment,
    • account management,
    • handling returns and complaints,
    • legal and tax compliance,
    • marketing (with consent).
  3. The legal basis for processing is Article 6(1)(a–f) of the GDPR (EU Regulation 2016/679).
  4. Data may be shared with partners necessary to perform the contract: logistics, payment, IT, and accounting service providers.
  5. Data are not transferred outside the EEA unless necessary for international deliveries with adequate protection standards.
  6. The data retention period covers contract execution and statutory record-keeping, after which data may be stored for legal claims.
  7. Customers have the right to access, rectify, delete, restrict, transfer, or object to data processing.
  8. Complaints about data processing may be filed with the President of the Personal Data Protection Office (UODO) or the relevant authority in the Customer’s country.
  9. Providing data is voluntary but necessary for order fulfillment.
  10. Details are described in the Privacy and Cookies Policy available on the store’s website.

11. Final Provisions

  1. These Terms and Conditions are available on the store’s website for viewing, download, or printing.
  2. The Seller may amend the Terms and Conditions for valid reasons, such as changes in law, services, payment methods, or delivery options.
  3. Updated Terms and Conditions apply to orders placed after their publication.
  4. Any matters not covered herein are governed by Polish law, including the Civil Code, the Consumer Rights Act, and relevant EU regulations.
  5. In case of a dispute, the parties shall first attempt an amicable settlement.
    Failing that, the dispute shall be resolved by a competent court in Poland, unless mandatory consumer protection law provides otherwise.
  6. The Terms and Conditions are drawn up in Polish and may be available in English for convenience.
    In case of discrepancies, the Polish version shall prevail.
  7. These Terms and Conditions take effect on [insert date] and remain valid until amended or revoked.
